{"id":14998,"date":"2022-02-05T01:53:34","date_gmt":"2022-02-05T00:53:34","guid":{"rendered":"https:\/\/hyfac.fr\/?page_id=14998"},"modified":"2022-02-05T02:14:36","modified_gmt":"2022-02-05T01:14:36","slug":"cgv","status":"publish","type":"page","link":"https:\/\/hyfac.fr\/en\/cgv\/","title":{"rendered":"GTC"},"content":{"rendered":"<p>We invite you to carefully read these general terms and conditions of sale (the \"GTCS\").<\/p>\n\n\n\n<p>Dans le cadre des pr\u00e9sentes CGV, il est convenu que \u00ab Vous \u00bb ou \u00ab&nbsp;l\u2019acheteur \u00bb d\u00e9signe la personne naviguant sur le Site et\/ou commandant des Produits sur le Site ; \u00ab Nous \u00bb ou le \u00ab Vendeur \u00bb d\u00e9signe la soci\u00e9t\u00e9 identifi\u00e9e dans les mentions l\u00e9gales ci-dessus ; l\u2019Acheteur et le Vendeur seront collectivement d\u00e9nomm\u00e9s les \u00ab Parties \u00bb et individuellement d\u00e9nomm\u00e9s la \u00ab Partie \u00bb.<\/p>\n\n\n\n<p>These terms and conditions apply to the exclusion of all other conditions, in particular those applicable to in-store sales or sales via other distribution or marketing channels.<\/p>\n\n\n\n<p>In accordance with the applicable legal and regulatory provisions, it is reminded that the validation of the order as specified in the present GCS, constitutes an electronic contract between the Parties which is proof between the Parties of the completeness of the order and of the payability of the sums due in execution of the said order.<\/p>\n\n\n\n<h2 id=\"conditions-d-achat\">CONDITIONS OF PURCHASE<\/h2>\n\n\n\n<p>The products we offer on the site are reserved for people of legal age (or minors who hold an authorization from their legal representative allowing them to place an order on the site) and who have full legal capacity to place orders on the site. We reserve the right at any time to ask you for proof of identity attesting to your age and\/or the aforementioned authorization from your legal representative. We reserve the right not to respond to an order and\/or to exclude from our customer\/prospect database, a buyer who has not responded to the above request or who does not meet the requirements set out in this clause.&nbsp;<\/p>\n\n\n\n<p>It is specified that the products are intended for the personal use of the Buyer, which must not be related to the Buyer's professional activity, including any resale of the product. In this respect, the Buyer's attention is particularly drawn to the fact that the amount of his orders must not exceed the sum of \u20ac500 (five hundred euros) per order.<\/p>\n\n\n\n<p>Finally, the same buyer is only authorized to place two orders per day. In the event of an order exceeding the above-mentioned amount and\/or number, the order may be considered null and void.<\/p>\n\n\n\n<h2 id=\"produits-et-prix\">PRODUCTS AND PRICES<\/h2>\n\n\n\n<p><strong>1. Products<\/strong><\/p>\n\n\n\n<p>The Products offered for sale on the Site are those shown on the Site on the day the Buyer consults the Site.<\/p>\n\n\n\n<p>The buyer is informed that the photographs and texts illustrating the Products are subject to change.<\/p>\n\n\n\n<p><strong>2. Unavailability of a product<\/strong><\/p>\n\n\n\n<p>If a product is unavailable, you will be informed :<\/p>\n\n\n\n<ul><li>Or, when the order is placed: a message is displayed indicating that the desired Product is temporarily unavailable,<\/li><li>Or, following validation of the order and before delivery, by e-mail.<\/li><\/ul>\n\n\n\n<p>If the order is validated by the Buyer, he\/she is then informed of the choice available to him\/her, i.e. (i) to be delivered a single partial order, without the product(s) unavailable at the date of the order, or (ii) to cancel the entire order.<\/p>\n\n\n\n<p>The Buyer then has forty-eight (48) working hours (excluding weekends and public holidays) from receipt of the information e-mail sent by the Seller to confirm via the procedure proposed by the Seller:<\/p>\n\n\n\n<ul><li>Cancellation of the entire order,<\/li><li>Or shipment of the partial order under special delivery conditions specified by the seller.<\/li><\/ul>\n\n\n\n<p>After this period of forty-eight (48) hours, and if no request from the Buyer has been sent to the Seller via the procedure specified by the Seller, the partial order will be dispatched to the Buyer and delivered at the standard delivery rate indicated in the table in Article \"Prices\" below. The price of the order is then invoiced to the Buyer, less the price corresponding to the unavailable product(s).<\/p>\n\n\n\n<p>In the event that the full price has been received directly at the time of the Buyer's order, the Vendor undertakes to reimburse the Buyer for the portion of the price corresponding to the Product(s) not available within a maximum period of fourteen (14) days from the notification of non-availability sent to the Buyer, and according to the method of payment used by the Buyer.<\/p>\n\n\n\n<p>In the event that the buyer requests the cancellation of the entire order, the price of the order will not be cashed.<\/p>\n\n\n\n<p><strong>3. Awards<\/strong><\/p>\n\n\n\n<p>Prices are quoted in euros (\u20ac) and are valid in mainland France, including Corsica. They include any discounts and VAT applicable on the date of the order. Any change in the applicable VAT rate will be reflected in the price of the Products.<\/p>\n\n\n\n<p>The prices indicated do not include processing and delivery charges, which will be indicated before the order is validated and invoiced in addition. They amount per order to the amount indicated in the table below:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Delivery mode&nbsp;<\/strong><\/td><td><strong>Price per order<\/strong><\/td><\/tr><tr><td>Colissimo<\/td><td>2,10 euros<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>The Vendor reserves the right to modify its prices at any time, but products are invoiced on the basis of the rates in force at the time the order is registered.<\/p>\n\n\n\n<h2 id=\"garanties-legales\">LEGAL WARRANTIES<\/h2>\n\n\n\n<p><strong>1. Description of legal warranties<\/strong><\/p>\n\n\n\n<p>In accordance with Articles L. 217-4 et seq. of the French Consumer Code, the Vendor is obliged to deliver a Product that conforms to the order placed by the Buyer and is liable for any defects in conformity existing at the time of delivery.<\/p>\n\n\n\n<p>To comply with the contract, the Product must :<\/p>\n\n\n\n<p>1\u00b0 Be suitable for the use normally expected of a similar Product and, where applicable :<\/p>\n\n\n\n<p>- Correspond to the description given by the Seller and possess the qualities that the Seller has presented to the Buyer in the form of a sample or model;<\/p>\n\n\n\n<p>- have the qualities that a Buyer may legitimately expect in the light of public statements made by the Seller, the producer or his representative, particularly in advertising or labelling;<\/p>\n\n\n\n<p>2\u00b0 Or have the characteristics defined by mutual agreement between the Parties or be suitable for any special use sought by the Buyer, brought to the attention of the Seller and accepted by the latter.<\/p>\n\n\n\n<p>Likewise, in accordance with article 1641 of the French Civil Code, the Vendor is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the Purchaser would not have purchased it, or would have paid a lower price for it, had he or she been aware of them.<\/p>\n\n\n\n<p><strong>2. Procedure<\/strong><\/p>\n\n\n\n<p>Si les Produits livr\u00e9s sont non-conformes aux Produits command\u00e9s par l\u2019Acheteur ou s\u2019ils pr\u00e9sentent des vices-cach\u00e9s, ce dernier doit envoyer un courrier \u00e9lectronique au Service client du Vendeur\u00a0\u00e0\u00a0<a>contact@moulinroyal.com<\/a>to notify him of the non-conformity or defects of his Product(s).<\/p>\n\n\n\n<p>In accordance with article L 217-12 of the French Consumer Code and 1648 paragraph 1 of the French Civil Code, the Buyer has a period of 2 (two) years from the date of delivery of the Products purchased to exercise the warranty against hidden defects or the legal warranty of conformity. Any claim made after this period of 2 (two) years from the date of taking possession of the goods in the case of non-conformity, or from the date of discovery of the defect in the case of latent defects, will be rejected and the Vendor will be released from all liability.<\/p>\n\n\n\n<p>The Vendor's Customer Service acknowledges receipt of the Buyer's request and confirms the procedure to be followed. On receipt of instructions from the Vendor's Customer Service Department, the Buyer shall return the non-conforming Products or those affected by a defect to the Vendor at the following address:<\/p>\n\n\n\n<p>Laboratoires Moulin Royal Cosmetics<\/p>\n\n\n\n<p>19 avenue de Cambridge<\/p>\n\n\n\n<p>14200 H\u00e9rouville Saint Clair<\/p>\n\n\n\n<p>Please indicate Fotoker on the parcel.<\/p>\n\n\n\n<p>The Product(s) must be returned complete, unused, in its (their) undamaged original packaging and (ii) as far as possible accompanied by its (their) original packaging as well as the return slip and a photocopy of the invoice.<\/p>\n\n\n\n<p>Furthermore, the Vendor does not accept packages sent carriage forward. All risks related to the return of the Product(s) are the responsibility of the Buyer.<\/p>\n\n\n\n<p>Upon receipt of the Product(s) presumed to be non-conforming or affected by a latent defect, the Vendor carries out an inspection of the Product(s) to ascertain whether or not the said Product(s) conform(s). Similarly, the Seller may carry out a quality test on the Product(s) returned by the Buyer to verify that the Product(s) returned are indeed original Product(s). It is understood that these checks are carried out as soon as possible and within a maximum period of one (1) month from receipt of the Product(s).<\/p>\n\n\n\n<p><strong>3. Content of legal warranties<\/strong><\/p>\n\n\n\n<p>If the non-conformity of the Product(s) is confirmed or the defect is proven :<\/p>\n\n\n\n<p>The Purchaser may choose between repair and replacement of the Product, subject to the cost conditions stipulated in article L. 217-9 of the French Consumer Code. It should be noted that the Buyer (i) has a period of two (2) years from delivery of the Product in which to take action and (ii) is exempt from proving the existence of the Product's lack of conformity during the twenty-four (24) months following delivery of the Product.<\/p>\n\n\n\n<p>In the event of the Buyer invoking the warranty against latent defects in the item sold under article 1641 of the French Civil Code, he may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.<\/p>\n\n\n\n<h2 id=\"enregistrement-et-validation-de-la-commande\">ORDER REGISTRATION AND VALIDATION<\/h2>\n\n\n\n<p><strong>1. How to order<\/strong><\/p>\n\n\n\n<p>The Buyer has the possibility of taking note of the product offered for sale on the day of consultation of the Site.<\/p>\n\n\n\n<p>While browsing the Site, the Buyer wishing to place an order may do so simply by clicking on the button to add the Product to the shopping basket.<\/p>\n\n\n\n<p>Once this operation has been completed, the number of products in the Buyer's basket is displayed. We draw the Buyer's attention to the fact that the contents of the basket may be subject to an expiry date.<\/p>\n\n\n\n<p>The Buyer can then continue his visit or click on his shopping basket to see the contents of his basket displayed on the screen, including all the elements of the order and in particular the essential characteristics of the product, the total amount of the order, the invoicing and delivery details, the costs and any delivery restrictions, as well as the rights and legal guarantees available to the Buyer.<\/p>\n\n\n\n<p>The Purchaser may return to his\/her basket, add to it, modify it or cancel it until it has been definitively validated. If the Buyer wishes to select other products, he\/she may continue browsing the Site, safe in the knowledge that the product(s) he\/she has just selected is\/are still in his\/her shopping basket.<\/p>\n\n\n\n<p>Once the selection of products has been completed, the Buyer can order them by validating the order via the button provided for this purpose. A new page will then open, inviting the Buyer to either :<\/p>\n\n\n\n<p>- Connect by entering your login (e-mail address) and password if the Buyer is already registered on the Site,<\/p>\n\n\n\n<p>- accurately complete a personal data collection form by filling in the mandatory fields, in particular Last name, First name, Company name, E-mail address, Billing postal address, Delivery postal address<\/p>\n\n\n\n<p>The Buyer undertakes to complete the form provided in good faith. The Buyer acknowledges that the data communicated to the Vendor and stored in the Vendor's and\/or its subcontractors' information systems are accurate and constitute proof of identity.<\/p>\n\n\n\n<p>After checking the contents of the order, the Buyer is invited :<\/p>\n\n\n\n<p>- click on the button to proceed to payment of the order, under the conditions described in these GTC;<\/p>\n\n\n\n<p>- click on the button to modify the basket and\/or personal information;<\/p>\n\n\n\n<p>By clicking on the button giving access to the payment of the order, the Buyer must first read these GTC, and then confirm his agreement to all the GTC by carrying out an action of confirmation of acceptance required on the Site (for example by ticking a box).<\/p>\n\n\n\n<p>As soon as the Buyer confirms acceptance of the GCS, an Internet page dedicated to payment of the order opens. All orders are subject to payment, which means that placing an order implies payment by the Buyer.<\/p>\n\n\n\n<p>The Buyer must then proceed with payment of his order under the conditions described in these GTC.<\/p>\n\n\n\n<p>The computerized registers or any other data recorded by the Seller constitute proof of all transactions between the Seller and the Buyer.<\/p>\n\n\n\n<p><strong>2. Order confirmation<\/strong><\/p>\n\n\n\n<p>Once the order has been confirmed and payment validated as described below, a printable and saveable summary of the buyer's order is displayed, including the order references.<\/p>\n\n\n\n<p>An order confirmation e-mail is sent as soon as possible by the Vendor to the e-mail address provided by the buyer and includes the following information:<\/p>\n\n\n\n<p>- the Vendor's identity and contact details,<\/p>\n\n\n\n<p>- the order reference recorded at the time the order was placed,<\/p>\n\n\n\n<p>- the summary of the order and the essential characteristics of the Products,<\/p>\n\n\n\n<p>- delivery times, costs and any delivery restrictions,<\/p>\n\n\n\n<p>- the total amount of the order, including all taxes,<\/p>\n\n\n\n<p>- the legal rights and guarantees available to the Buyer,<\/p>\n\n\n\n<p>- payment confirmation,<\/p>\n\n\n\n<p>- the present General Terms and Conditions of Sale.<\/p>\n\n\n\n<p>The Vendor retains ownership of the product(s) ordered until full payment of the price and accessories, including shipping costs, has been received by the Vendor. In the event of a payment incident, the purchaser undertakes to return to the Vendor, at his own expense, the products received, on first request.<\/p>\n\n\n\n<p>In order to protect the Vendor from abusive practices by fraudsters, and in the event that the Vendor or the online payment service provider suspect the fraudulent nature of an order, they reserve the right to ask the purchaser (prior to processing the order) for additional documents in order to verify the non-fraudulent nature of the order.<\/p>\n\n\n\n<p>In the absence of a response from the purchaser within fifteen (15) days of the request being sent by the Vendor or the online payment service provider, the order will be cancelled and no payment will be collected by the Vendor. In the event that payment for the order has already been received, the Vendor will reimburse the Buyer within fourteen (14) days of the expiry of the aforementioned deadline, according to the payment method used by the Buyer.<\/p>\n\n\n\n<p><strong>3. Proof of order<\/strong><\/p>\n\n\n\n<p>It is expressly agreed between the Vendor and the Buyer that e-mails are deemed authentic between the Parties, as are the automatic recording systems used on the Site, particularly with regard to the nature and date of the order.<\/p>\n\n\n\n<p>L\u2019Acheteur peut acc\u00e9der, le cas \u00e9ch\u00e9ant conform\u00e9ment aux r\u00e8gles du droit commun, au contrat \u00e9lectronique conclu entre l\u2019Acheteur et le Vendeur. Il s&#8217;adresse pour ce faire au Service Client (O2.31.44.46.51)&nbsp;ici&nbsp;auquel il fournira toutes les informations n\u00e9cessaires pour ce faire, notamment le num\u00e9ro de commande et ses coordonn\u00e9es.<\/p>\n\n\n\n<h2 id=\"paiement\">PAYMENT<\/h2>\n\n\n\n<p>The amount due by the Buyer is the amount indicated on the order confirmation as displayed on the web page dedicated to this purpose and subsequently transmitted by e-mail by the Seller to the Buyer.<\/p>\n\n\n\n<p>The Buyer may choose between different methods of payment when validating the order as specified above.<\/p>\n\n\n\n<p>Le paiement s\u2019effectue :<\/p>\n\n\n\n<p>&#8211; au moment de la commande, par internet, par Carte Bancaire (Visa, Amex, Mastercard)<\/p>\n\n\n\n<p>&#8211; au moment de la commande, par internet, par son compte Paypal<\/p>\n\n\n\n<p>Il est pr\u00e9cis\u00e9 que le Vendeur refusera toute commande pour laquelle la Carte Bancaire utilis\u00e9e expire dans les 7 jours suivants la date de passation de la commande.<\/p>\n\n\n\n<p>La commande n\u2019est valid\u00e9e par le Vendeur qu&#8217;apr\u00e8s acceptation des CGV par l\u2019Acheteur, v\u00e9rification et confirmation de la validit\u00e9 du paiement et envoi \u00e0 l\u2019Acheteur de la confirmation de l\u2019acceptation de sa commande.<\/p>\n\n\n\n<p>En tout \u00e9tat de cause, le Vendeur se r\u00e9serve le droit de refuser toute commande ou toute livraison en cas de d\u00e9passement des plafonds indiqu\u00e9s en article \u00ab Conditions d\u2019Achat \u00bb des pr\u00e9sentes, de litige existant avec l&#8217;Acheteur, de non-paiement total ou partiel d&#8217;une commande pr\u00e9c\u00e9dente par l&#8217;Acheteur, de refus d&#8217;autorisation de paiement par carte bancaire des organismes bancaires, de non-paiement ou de paiement partiel et d\u2019expiration de la carte bancaire, utilis\u00e9e pour le paiement, dans les conditions pr\u00e9vues ci-dessus..<\/p>\n\n\n\n<p>Le Vendeur reste propri\u00e9taire des produits jusqu\u2019au parfait encaissement du prix complet par lui.<\/p>\n\n\n\n<h2 id=\"livraison-et-reception\">LIVRAISON ET RECEPTION<\/h2>\n\n\n\n<p><strong>1. Modalit\u00e9s de livraison<\/strong><\/p>\n\n\n\n<p>Une fois la commande pr\u00e9par\u00e9e elle est exp\u00e9di\u00e9e \u00e0 l&#8217;adresse postale renseign\u00e9e par l\u2019Acheteur \u00e0 l&#8217;occasion de sa commande.<\/p>\n\n\n\n<p>&#8211; Colissimo : en cas d&#8217;absence de l\u2019Acheteur, le Transporteur laisse un avis de passage dans la bo\u00eete aux lettres de l\u2019Acheteur. L\u2019Acheteur doit alors reprendre contact avec le Transporteur afin de convenir d&#8217;une nouvelle date de livraison. Il est n\u00e9anmoins pr\u00e9cis\u00e9 que si l\u2019Acheteur ne reprend pas contact avec le Transporteur, ce dernier r\u00e9alise deux nouveaux essais de livraison dont la date et l&#8217;heure seront d\u00e9termin\u00e9es discr\u00e9tionnairement par le Transporteur. Le colis est conserv\u00e9 par le Livreur pendant une p\u00e9riode de quinze (15) jours apr\u00e8s la premi\u00e8re pr\u00e9sentation.<\/p>\n\n\n\n<p><strong>2. D\u00e9lais<\/strong><\/p>\n\n\n\n<p>Les commandes sont trait\u00e9es dans un d\u00e9lai maximum de deux (2) jours ouvr\u00e9s.<\/p>\n\n\n\n<p>Il est rappel\u00e9 qu\u2019une commande n&#8217;est achemin\u00e9e qu\u2019une fois qu\u2019elle aura \u00e9t\u00e9 trait\u00e9e et que le paiement aura bien \u00e9t\u00e9 confirm\u00e9.<\/p>\n\n\n\n<p>A compter du traitement de la commande, sous r\u00e9serve des modalit\u00e9s de livraisons ci-dessus, les Produits correspondants sont achemin\u00e9s et livr\u00e9s par le Transporteur dans les d\u00e9lais suivants :<\/p>\n\n\n\n<p>&#8211; livraison par Colissimo : 48h \u00e0 72h (deux (2) \u00e0 trois (3) jours ouvr\u00e9s)<\/p>\n\n\n\n<p>Les dimanches et jours f\u00e9ri\u00e9s ne sont pas consid\u00e9r\u00e9s comme \u00e9tant des jours ouvr\u00e9s.<\/p>\n\n\n\n<p>En tout \u00e9tat de cause, la commande est ex\u00e9cut\u00e9e dans un d\u00e9lai maximum de trente (30) jours \u00e0 compter du jour suivant celui o\u00f9 l\u2019Acheteur a valid\u00e9 sa commande, sous r\u00e9serve du paiement complet du prix et du respect des conditions d\u2019achat d\u00e9finies \u00e0 l\u2019article \u00ab Conditions d\u2019Achat \u00bb des pr\u00e9sentes CGV.<\/p>\n\n\n\n<p>Faute de livraison \u00e0 l&#8217;expiration de ce d\u00e9lai, l\u2019Acheteur a la possibilit\u00e9 d&#8217;annuler sa commande dans les conditions pr\u00e9vues \u00e0 l&#8217;article \u00ab Retard de Livraison \u00bb ci-apr\u00e8s.<\/p>\n\n\n\n<p><strong>3. Retard de livraison<\/strong><\/p>\n\n\n\n<p>En cas de retard de livraison (d\u00e9passement du d\u00e9lai de livraison indiqu\u00e9 ou, \u00e0 d\u00e9faut, du d\u00e9lai maximal de livraison de trente (30) jours apr\u00e8s validation de la commande), l\u2019Acheteur doit, dans les meilleurs d\u00e9lais, signaler ce retard au Vendeur par courrier \u00e9lectronique \u00e0&nbsp;<a>contact@moulinroyal.com<\/a>et ce, afin que le Vendeur puisse faire effectuer une enqu\u00eate aupr\u00e8s du Transporteur.<\/p>\n\n\n\n<p>Si au cours de cette enqu\u00eate, la commande est retrouv\u00e9e, elle est imm\u00e9diatement r\u00e9achemin\u00e9e au lieu de livraison d\u00e9sign\u00e9 dans la commande. En revanche, si \u00e0 l&#8217;issue de cette enqu\u00eate la perte de la commande est confirm\u00e9e, le Vendeur effectue, \u00e0 ses frais, une r\u00e9exp\u00e9dition du ou des Produit(s) \u00e0 l\u2019Acheteur ou en cas d&#8217;indisponibilit\u00e9 d\u00e9finitive, effectue un remboursement de la totalit\u00e9 des sommes vers\u00e9es par l\u2019Acheteur (frais de livraison inclus), selon le mode de paiement utilis\u00e9.<\/p>\n\n\n\n<p>En tout \u00e9tat de cause, en cas de retard de livraison de plus de 30 (trente) jours ouvr\u00e9s \u00e0 compter du courrier \u00e9lectronique de l\u2019Acheteur signalant le retard, non d\u00fb \u00e0 un cas de force majeure, l\u2019Acheteur a la possibilit\u00e9 d&#8217;annuler sa commande aupr\u00e8s du Service Client au&nbsp;02.31.44.46.51.<\/p>\n\n\n\n<p>Si l\u2019Acheteur exerce ce droit de d\u00e9nonciation dans les conditions du pr\u00e9sent article, le prix de la commande ne sera pas encaiss\u00e9 par le Vendeur.<\/p>\n\n\n\n<p>Dans l\u2019hypoth\u00e8se o\u00f9 le paiement de la commande aurait d\u00e9j\u00e0 \u00e9t\u00e9 encaiss\u00e9, le Vendeur effectue un remboursement de la totalit\u00e9 des sommes vers\u00e9es par l\u2019Acheteur (frais de livraison inclus), selon le mode de paiement utilis\u00e9 dans un d\u00e9lai maximum de quatorze (14) jours \u00e0 compter de la r\u00e9ception de la d\u00e9nonciation, et ce, \u00e0 l&#8217;exclusion de toute autre indemnisation. A ce titre, l\u2019attention de l\u2019Acheteur est attir\u00e9e sur le fait que la carte bancaire ayant servi au paiement doit toujours \u00eatre en cours de validit\u00e9 afin de permettre un remboursement dans le respect du d\u00e9lai pr\u00e9cit\u00e9.<\/p>\n\n\n\n<p><strong>4. R\u00e9ception<\/strong><\/p>\n\n\n\n<p>Chaque livraison est r\u00e9put\u00e9e effectu\u00e9e d\u00e8s mise \u00e0 disposition du ou des Produit(s) par le Transporteur aupr\u00e8s de l\u2019Acheteur, ou d\u2019un tiers indiqu\u00e9 par l\u2019Acheteur. Il appartient \u00e0 l\u2019Acheteur de v\u00e9rifier imm\u00e9diatement au moment de la r\u00e9ception du\/des Produit(s) la conformit\u00e9 et l&#8217;int\u00e9grit\u00e9 du ou des Produit(s) exp\u00e9di\u00e9(s).<\/p>\n\n\n\n<p>Toute anomalie\/r\u00e9serve identifi\u00e9e au moment de la livraison (notamment livraison en retard, produit manquant ou endommag\u00e9) doit \u00eatre signal\u00e9e de fa\u00e7on compl\u00e8te et pr\u00e9cise par l\u2019Acheteur sur le r\u00e9c\u00e9piss\u00e9 remis par le Transporteur au moment de la mise \u00e0 disposition des Produits et\/ou confirm\u00e9 par lettre recommand\u00e9e au Transporteur dans les dix (10) jours qui suivent la r\u00e9ception de la commande.<\/p>\n\n\n\n<p>Toute r\u00e9serve de ce type doit \u00eatre notifi\u00e9e en parall\u00e8le et dans les meilleurs d\u00e9lais au Service Client du Vendeur. Une copie de la r\u00e9clamation adress\u00e9e au Transporteur devra \u00eatre jointe.<\/p>\n\n\n\n<h2 id=\"droit-de-retractation\">DROIT DE RETRACTATION<\/h2>\n\n\n\n<p><strong>1. La notification au Vendeur de la d\u00e9cision de r\u00e9tractation<\/strong><\/p>\n\n\n\n<p>L\u2019Acheteur dispose d&#8217;un droit de r\u00e9tractation qu\u2019il peut exercer dans un d\u00e9lai de quatorze (14) jours francs, sans avoir \u00e0 donner des motifs, ni \u00e0 payer de p\u00e9nalit\u00e9s, \u00e0 l\u2019exception des frais de retour qui sont \u00e0 sa charge. Ce d\u00e9lai de r\u00e9tractation expire quatorze (14) jours francs apr\u00e8s le jour o\u00f9 l\u2019Acheteur, ou un tiers qu\u2019il aura d\u00e9sign\u00e9 autre que le Transporteur, prend physiquement possession des Produits.<\/p>\n\n\n\n<p>Si l\u2019Acheteur a command\u00e9 plusieurs Produits lors d&#8217;une seule commande, ou que la livraison des Produits a \u00e9t\u00e9 effectu\u00e9e en plusieurs parties, le d\u00e9lai de r\u00e9tractation ne commence pas avant que l\u2019Acheteur, ou un tiers d\u00e9sign\u00e9 par lui autre que le Transporteur, ne prenne physiquement possession du dernier Produit ou de la derni\u00e8re partie de la livraison.<\/p>\n\n\n\n<p>Pour exercer son droit de r\u00e9tractation, l\u2019Acheteur doit faire parvenir sa d\u00e9cision de r\u00e9tractation au Vendeur par toute d\u00e9claration d\u00e9nu\u00e9e d\u2019ambigu\u00eft\u00e9 avant l\u2019expiration du d\u00e9lai de r\u00e9tractation, notamment :<\/p>\n\n\n\n<ul><li>par courrier postal \u00e0 l\u2019adresse suivante : laboratoires Moulin Royal Cosmetics \u2013 19 avenue de Cambridge \u2013 14200 H\u00e9rouville Saint Clair<\/li><li>par email \u00e0 l\u2019adresse suivante : contact@moulinroyal.com<\/li><\/ul>\n\n\n\n<p>Pour faciliter le traitement du retour, il est recommand\u00e9 \u00e0 l\u2019Acheteur de remplir et transmettre le formulaire de r\u00e9tractation : \u00e0 remplir en ligne<strong>here<\/strong>. Dans ce cas, d\u00e8s r\u00e9ception du formulaire par le Vendeur, le Vendeur accuse r\u00e9ception de cette demande via l\u2019envoi d\u2019un e-mail ou d\u2019une lettre.<\/p>\n\n\n\n<p>Pour que le d\u00e9lai de r\u00e9tractation soit respect\u00e9, il suffit que l\u2019Acheteur transmette sa communication relative \u00e0 l\u2019exercice du droit de r\u00e9tractation avant l\u2019expiration du d\u00e9lai de r\u00e9tractation.<\/p>\n\n\n\n<p><strong>2. Le renvoi des Produits objet de la r\u00e9tractation&nbsp;<\/strong><\/p>\n\n\n\n<ul><li>Suivant la communication de l\u2019Acheteur de sa d\u00e9cision de se r\u00e9tracter, l\u2019Acheteur doit renvoyer au Vendeur le(s) Produit(s) complet(s), non utilis\u00e9(s), dans son(leur) conditionnement d\u2019origine intact et dans la mesure du possible accompagn\u00e9(s) de son (leur) emballage d&#8217;origine ainsi que du bon de retour et d\u2019une copie de la facture, sans retard excessif et au plus tard dans un d\u00e9lai de quatorze (14) jours suivant la communication par l\u2019Acheteur de sa d\u00e9cision de se r\u00e9tracter, \u00e0 laboratoires Moulin Royal Cosmetics \u2013 19 avenue de Cambridge \u2013 14200 H\u00e9rouville Saint Clair .Ce d\u00e9lai est r\u00e9put\u00e9 respect\u00e9 si les Produits sont renvoy\u00e9s avant l\u2019expiration du d\u00e9lai de r\u00e9tractation de quatorze (14) jours.<\/li><\/ul>\n\n\n\n<p>A d\u00e9faut de notifier au Vendeur sa volont\u00e9 de r\u00e9tractation dans un d\u00e9lai de quatorze (14) jours \u00e0 compter de la r\u00e9ception effective de la commande et de renvoyer les Produits dans un d\u00e9lai de quatorze (14) jours suivant la communication par l\u2019Acheteur de sa d\u00e9cision de se r\u00e9tracter, aucun remboursement ne pourra intervenir.<\/p>\n\n\n\n<p>Les frais de retour du ou des Produit(s) demeurent \u00e0 la charge de l\u2019Acheteur.<\/p>\n\n\n\n<p><strong>3. Le remboursement des Produits objet de la r\u00e9tractation&nbsp;<\/strong><\/p>\n\n\n\n<p>Le Vendeur s&#8217;engage \u00e0 rembourser l\u2019Acheteur de la totalit\u00e9 des sommes vers\u00e9es, en ce compris les frais de livraison (\u00e0 l&#8217;exception des frais de livraisons suppl\u00e9mentaires d\u00e9coulant du fait que l\u2019Acheteur a choisi, le cas \u00e9ch\u00e9ant, un mode de livraison autre que le mode moins co\u00fbteux de livraison standard propos\u00e9 par le Vendeur).<\/p>\n\n\n\n<p>Sauf accord expr\u00e8s de l\u2019Acheteur pour un autre moyen de remboursement, le remboursement du\/des Produit(s) s&#8217;effectue selon le mode de paiement originale utilis\u00e9 par l\u2019Acheteur, sans retard excessif et, en tout \u00e9tat de cause, au plus tard dans un d\u00e9lai de quatorze (14) jours \u00e0 compter du jour o\u00f9 le Vendeur est inform\u00e9 de la d\u00e9cision de r\u00e9tractation de l\u2019Acheteur. Ce remboursement n\u2019occasionnera aucun frais pour l\u2019Acheteur. Non-validit\u00e9 partielle<\/strong><\/p>\n\n\n\n<p>Si une ou plusieurs stipulations des pr\u00e9sentes CGV sont tenues pour non-valides ou d\u00e9clar\u00e9es comme telles en application d&#8217;une loi, d&#8217;un r\u00e8glement ou \u00e0 la suite d&#8217;une d\u00e9cision d\u00e9finitive d&#8217;une juridiction comp\u00e9tente, les autres stipulations gardent toute leur force et leur port\u00e9e.<\/p>\n\n\n\n<p><strong>3.
